In 1998 the government instigated two Acts that directly affected the use of materials handling equipment in the workplace:

• LOLER 98 (Lifting Operations & Lifting Equipment Regulation 98). Effectively an MOT for forklift trucks and warehouse equipment
• PUWER 98 (Provision and Use of Work Equipment Regulations 98) that inspects specifically the safety items associated with the machine.

The employer of the operator of the forklift truck or warehouse equipment is ultimately responsible for ensuring that the equipment is inspected, documented and resulting actions taken accordingly.
